These Terms and Conditions shall be exclusively governed by, interpreted and construed in all respects in according with Belgian law. Any dispute, controversy, proceedings or claims of whatsoever nature arising out or in any way relating to these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Belgium.
The materials on Clubnode's website are provided 'as is'. Clubnode makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Furthermore, Clubnode does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its internet website or otherwise relating to such materials or on any sites linked to this site.
In no event shall Clubnode or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on Clubnode, even if Clubnode or a Clubnode authorised representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
You agree to follow these policies:
- Our plans shall be used strictly for their advertised purpose, i.e. a Game server shall strictly be a Game server. Resources shall not be diverted for storage, third-party software or any purpose other than advertised.
- Shared plans not advertised as dedicated see their resources monitored. You are allowed bursts of computing power made available to you, however, continuous use of said computing power may lead to warnings, throttling and/or termination.
- You shall not attempt to compromise security and/or attempt to access data and files that are not of your belonging.
In the event you are found to be in non-compliance with our policies in any way, we reserve the right to cancel your account with us. A refund may not be granted.
If your account is overdue, Clubnode reserves the right to suspend and disable access to services until the payment is made. Related data may be kept up to 1 week, after which it shall be destroyed permanently.
Our engineering team may provide support solely for Clubnode services and related controls, as well as any problem that may be of Clubnode's fault.
It is your responsibility to ensure that third-party software you are using is legitimate and correctly configured. Clubnode takes no responsibility for compatibility or performance issues that may arise from the use of such software.
You are responsible for maintaining and ensuring the quality of your backups, including backups made with software granted by Clubnode. You may back up to an external location.
You should receive an email with pertinent information swiftly after payment; products are set up and delivered automatically, unless express mention of the contrary. Should the server not set up, please contact Clubnode either via the ticketing system built in to the billing system or via email at support@clubnode.com.
Promotional codes do not stack with other promotional codes or quarterly, semi annual, or annual discounts unless otherwise stated.
We have the right to provide or deny refunds for any reason, regardless of our refund policy. All addons (Dedicated IP, Server Setup, etc..) are non-refundable. Refunds will only be granted if there is an issue that is of Clubnode's doing. However, refunds will not be granted if we are not given an opportunity to rectify any issue. Refunds are also not granted if the issue results from misuse or misconfiguration. If you've paid for multiple months we have the right to not issue a refund for whatever reason we provide. PayPal subscription refunds: We do not accept responsibility for users who have cancelled their services and not their PayPal subscriptions. The client will take full responsibility for negligence to the subscription, we reserve the right to not refund you. Adding funds to your account is non-refundable and can only be used for credit for Clubnode services.
Affiliation credits are only to be used towards Clubnode services, credits obtained from referrals shall not be converted into any other means of payment.
Our services may be provided as recurring subscriptions with the use of an automatic payment method. Payments will come out automatically until service is cancelled via the client area using our ticketing system requesting a 'Cancellation' or finding the cancel button in your product overview. Invoices are generated 1 week before the next due date to prevent downtime or suspension of service should any payment issues arise. Due to this feature if you pay using a credit card or PayPal it will pay the invoice at this time. Services must be cancelled 5 days before the next due date or no refund will be provided if an advanced invoice is paid. Those payments are not refundable as the service is considered active. If you wish not to be charged before specific dates please contact billing.
In order to cancel your plan you must first proceed to the cancellation in your product overview on our billing system or open a ticket to cancel your service. If you have cancelled your service, but failed to follow the directions on our cancellation reply, regarding potential automatic payments, refunds will not be granted. Any additional payments will be credited to your account within our system. If you fail to cancel your service 5 days before an invoice is due it will create a new invoice which if paid with the use of Stripe the payment will still be made and a refund shall not be granted. Failing to cancel can also lead to late fees and or Collections for some service categories, especially: dedicated servers. As soon as cancellation takes effect, all related data will be deleted from related systems.
Server Uptime is not guaranteed should a problem arise. However, the engineering team keeps regular and preventative maintenance on schedule as well as best efforts in order to prevent aforementioned problems.
